Process for law enforcement requesting any information on Sellix-powered businesses

To ensure transparency and trust on our platform, law enforcement entities from other countries are required to go through our Italian office due to concerns about maintaining compliance and integrity with international requests.

Policies and handling of requests

Sellix is committed to operating its business with the utmost integrity and highest ethical standards. That's why we believe every company that stores information should have policies and guidelines for responding to requests for business information from law enforcement agencies, courts, etc.

These principles describe how we will deal with law enforcement requests for Sellix business information.

Most of this information is intended for law enforcement, judicial, and regulatory personnel. If you are none of these and have questions, find answers in our help docs.

A valid legal process is required before disclosure

Sellix will disclose information in response to valid legal process in accordance with our Terms of Service and Privacy Policy and to the extent consistent with the laws and regulations within the Italian Republic and other applicable laws.

In fulfilling its legal obligations, Sellix respects each and every businesses' privacy. However, we can’t guarantee that the information described in the Privacy Policy or applicable Terms of Service will be available for any given business.

Stored business information

Sellix stores and maintains business information as described in our Privacy Policy and the applicable Terms of Service. You can find examples of information we store in our Privacy Policy.

Notice to businesses

Sellix has a policy of providing notice to the affected businesses regarding the legal process requesting information after 90 days from disclosure unless we are prohibited by law from doing so or in exceptional circumstances, such as emergencies or when notice would be counterproductive. We will also provide delayed notice upon expiration of a specific non-disclosure period in a court order and where we have a good faith belief that exceptional circumstances no longer exist and we are not otherwise prohibited by law from doing so.

Law enforcement officials who believe that notification would jeopardize an investigation should obtain an appropriate court order or other appropriate process establishing that notice is prohibited. If your data request draws attention to an ongoing violation of our terms of service, we will take action to prevent further abuse, including actions that may notify the business that we are aware of their misconduct.

Preservation requests

We will take steps to preserve account records in connection with official criminal investigations for a period of 90 days, which may be extended for an additional 90 days upon request by the governmental entity.

Expert testimony or authentication of evidence

Sellix does not provide expert testimony support. In addition, Sellix records are self-authenticating pursuant to law and should not require the testimony of a records custodian.

If a special form of certification is required, attach it to your subpoena or other legal processes.

Requirements to produce business information

To compel Sellix to provide any businesses information, you must obtain a valid subpoena, court order, or search warrant (“Law Enforcement Request”). To compel Sellix to provide any businesses content, you must obtain a valid search warrant.

Please send us an email at admin@sellix.io. When sending us an email, be sure to have the subject line as “Information Request - Law Enforcement”.

Each request must include contact information for the authorized law enforcement agency official submitting the request, including:

  • Requesting agency name

  • Requesting agent name and badge/identification number

  • Requesting agent employer-issued email address

  • Requesting agent phone contact, including any extension

  • Requesting agent mailing address (P.O. Box will not be accepted)

  • Requested response date (see details below for emergency requests)

Does the process differ for requests from international governmental authorities?

International governmental authorities should use the Mutual Legal Assistance Treaty (“MLAT”) request or letters rogatory process to seek business information from Sellix. Sellix will review and respond to properly submitted preservation requests while the MLAT or letters rogatory process is underway.

Requirements to share business information with law enforcement

To respond to your request(s), we’ll need:

  • The applicable documents described above

  • The unique username (sellix.io/[username]) and/or email address used to create their Sellix account

Cost reimbursement

We may seek reimbursement for costs in responding to requests for information as provided by law.

These fees apply on a per-account basis. We may also charge additional fees for costs incurred in responding to unusual or burdensome requests.

Emergency requests

If you are a business and are aware of imminent harm to an individual or individuals, please contact local law enforcement authorities immediately.

Sellix evaluates emergency requests on a case-by-case basis. If you provide information that gives us a good faith belief that there is an emergency involving imminent danger of death or serious physical injury to any person, we may provide information necessary to prevent that harm if we are in a position to do so, consistent with applicable law.
